The text on photo wallpapers [Addendum No. 7] concerns implied consent to the use of a work understood as a unilateral declaration of will. In it, I refer to German BGH rulings from 2024. In the text, I point out that the reasoning adopted by the BGH can be used to interpret analogous legal issues under Polish copyright law. Moreover, implied consent may have a broader scope of application in Poland due to the difficulties of constructing an implied license agreement under Polish law. This is related to the requirement under Article 41(2) of the Copyright Act that the fields of exploitation be explicitly listed in the license agreement.
