Lecture for corporate lawyers (ACC Europe and Katowice Economic University)

On April 14, 2016, Jarosław Sroczyński presented a lecture entitled “Remedies: is the OCCP a market regulator?” and discussed the 2015 and 2016 amendments of the Polish Competition Law. The lecture was organized for corporate lawyers (including legal advisors, advocates and applicants) by the Association of Corporate Counsel Europe (ACC Europe) and the Economic University in Katowice. ACC Europe is a part the Association of Corporate Counsel (ACC), established in 1982, which groups 40,000 members from 85 countries, employed in over 10,000 corporations.

„Merit for the Bar” awarded to Marcin Mioduszewski

On February 25, 2016, Marcin Mioduszewski was awarded by the President of the National Council of Legal Advisers the Silver Medal of the „Merit for the Bar”. This award was granted in recognition of the public activity of Mr. Mioduszewski, who has been assisting for many years the “Spring Association” (Stowarzyszenie Wiosna), the organizer of a well-known annual action for poor children called the “Noble Package”. Mr. Mioduszewski, inter alia, has set up the legal assistance structure of the Spring Association. In 2014, in recognition of his activity in the Spring Association, Mr. Mioduszewski was awarded by the National Council of Legal Advisors the prize of the “Crystal Heart of Legal Advisor”. Our sincere congratulations go to Marcin on this special occasion!

On March 7-8, 2016, MMC Conferences organized in Warsaw the workshop „The protection of undertakings’ rights in competition law”. At the workshop, Mr. Sroczyński was speaking about „The settlement in competition law”, analysing this new opportunity under the amended Antimonopoly Law.

Marcin Mioduszewski will conduct the student course „Agreement with IP – academy of contracts”

Between March 1 and May 31, 2016, Marcin Mioduszewski, as the initiator and author, will conduct the legal course for students of the Faculty of Law and Administration of the Jagiellonian University, entitled „Agreement with IP – academy of contracts”. During the course, consisting of 7 meetings, the participants will gain the practical knowledge on how to prepare transactions relating to intellectual property and will learn how to correctly create legal contracts and documents. The course is organized by the Intellectual Property Group of the student organization TBSP UJ, under the media patronage of the daily Dziennik Gazeta Prawna.

Comment by Jarosław Sroczyński for „Rzeczpospolita” on the introduction of the law on bank tax

Jaroslaw Sroczyński has commented for „Rzeczpospolita” the proceedings of the European Commission on the recent introduction in Poland of a new bank tax. The European Commission intends to verify the effect of the new tax on competition in the financial sector and whether it is not a hidden form of state aid. Mr. Sroczyński reflected on legal effects of a possible finding that the bank tax contains illegal mechanisms, discriminating some entities. See the article dated March 3, 2016:

Article by Piotr Suski entitled “Act on consumer rights and the electricity market”

An article by Piotr Suski entitled  “Act on Consumer Rights and the electricity market” was published in a new edition of the periodical “The Internet Antimonopoly and Regulatory Quartely” (iKAR 3(4)/2015). Piotr Suski presented new Polish provisions on consumer rights from the perspective of energy enterprises involved in the sale or distribution of electricity. The analysis includes such issues as: the scope of the application of the Act on Consumer Rights, information duties, specific rules on concluding contracts by phone as well as consumers’ right to withdrawal. Particular attention was paid to those provisions of the Act on Consumer Rights which cause significant doubts in the context of the relationship between energy law and consumer law or due to the conditions prevailing in the Polish electricity market.
