BOOK BY JANUSZ BARTA AND RYSZARD MARKIEWICZ ENTITLED ‘COPYRIGHT AND RELATED RIGHTS. “COPYRIGHT AND RELATED RIGHTS. INTRODUCTION” – X EDITION

A book by Janusz Barta and Ryszard Markiewicz entitled ‘Copyright and Related Rights’ has been published by Wolters Kluwer Polska. ‘Copyright and Related Rights. Introduction’. We bring it to your attention for three reasons. To quote after the author: ‘First, this is the first (our) 10th edition. Secondly, the book uses an innovative solution: new content is marked with lines in the margin. This will make it possible to compare it with the previous edition (2021), as well as to limit the reading to new copyright issues only. It seems to me that I have never seen this idea in another publication. Thirdly, the recently transposed into Polish law two EU Directives 2019/789 and 2019/790, the new Polish court and CJEU jurisprudence, and the currently debated problems of copyright law, in particular the author-legal problems of artificial intelligence and remuneration for creators, are included extensively. The latter issue is covered extensively in a separate chapter. It will probably be the subject of criticism because of the proposed interpretations of the amended copyright law and the suggested limitation of the scope of the right to post-contractual remuneration – so far nowhere in the world as broadly covered as in Poland (I wondered whether to title this chapter: Is there a pilot flying with us?”).

We wczorajszej Kronice TVP Kraków dr Michał Markiewicz udzielił wypowiedzi dotyczącej Off Radio Kraków i programu stworzonego przez algorytmy sztucznej inteligencji. Sprawa wywołuje spore zainteresowanie społeczne, także ze względu na ryzyko zastępowania dziennikarzy przez sztuczną inteligencję. Należy podkreślić, że brak przeciwskazań dla stworzenia radia zarządzanego przez AI. Algorytmy te już teraz stanowią użyteczne narzędzie w rękach człowieka, trudno wyobrazić sobie zakaz ich używania. Należy jednak rozsądnie i odpowiedzialnie korzystać z tych rozwiązań, a równocześnie mieć świadomość, że wraz z ich rozwojem oraz stosowaniem zostaną wytworzone nowe zwyczaje, jak te narzędzia należy wykorzystywać w określonych branżach, w tym w mediach. “Stworzenie radia w oparciu o decyzje podejmowane przez AI i oceniam jako ciekawy eksperyment. The issue is generating considerable public interest, not least because of the risk of journalists being replaced by artificial intelligence. It should be emphasised that there is no contraindication to the creation of a radio managed by AI. These algorithms are already a useful tool in the hands of humans, and it is difficult to imagine a ban on their use. However, it is important to use these solutions sensibly and responsibly, while being aware that with their development and use, new habits will be created as to how these tools should be used in specific industries, including the media. ‘Creating a radio based on decisions made by AI and I judge it as an interesting experiment. I wonder to what extent people will be interested in listening to such prepared programmes after the wow effect and interest in ‘something new’ has passed. DR MICHAŁ MARKIEWICZ FOR RZECZPOSPOLITA – INDUSTRIAL DESIGN – HOW TO READ WHAT WE PROTECT

In today’s Rzeczpospolita daily, Dr. Michal Markiewicz writes about industrial design and community designs (design protection) and points out the key decisions from the perspective of an entrepreneur at the time of filing a design for protection and their impact on the protection granted. At the same time he presents, among other things: how the scope of the granted right should be examined, how the way of interpreting a design differs in the case of an unregistered Community design, why there are situations in which, despite having the right to register a design, it is worthwhile to construct claims also based on the right to an unregistered Community design. It is also important to remember that design can, under certain conditions, be protected by copyright in parallel, as well as through the tort of unfair competition. DR MICHAŁ MARKIEWICZ FOR RZECZPOSPOLITA – ATTENTION! REVOLUTION IN COPYRIGHT CONTRACTS

This time, Dr. Michal Markiewicz in Rzeczpospolita describes the REVOLUTION that the legislator introduced as part of the amendment to the copyright law (which came into force on September 20, 2024). It is about the possibility of challenging the remuneration against any contract of paid license or transfer of copyright. This issue was, so to speak, on the sidelines of previous discussions, which mainly focused on the issue of “streaming royalties.” The article points out: what is “fair and adequate” remuneration, when the creator is entitled to remuneration described in accordance with the above requirements, in what case the legislator introduces a presumption that the remuneration specified in the contract is “fair and adequate”, how the amendment to the law may affect the practice of concluding copyright contracts, whether this regulation also applies to employment contracts under which works are created. He also draws attention to changes in the bestseller clause, which aim to facilitate the possibility of taking advantage of it. DEBUT DR. MICHAEL MARKIEWICZ AT ALMA MATER – ARTIFICIAL INTELLIGENCE AND COPYRIGHT LAW

Dr. Michal Markiewicz’s debut in ALMA MATER of the Jagiellonian University. The issue for the inauguration of the academic year includes a “light” summary of current problems with artificial intelligence (AI) algorithms from the perspective of copyright law. DR MICHAŁ MARKIEWICZ FOR THE RZECZPOSPOLITA – WHEN TO ‘NOT INCLUDE’ LICENSING

After a short break, in the pages of Rzeczpospolita, Michał Markiewicz points out an important aspect of legal and copyright law, i.e. the necessity for an entrepreneur to obtain rights to use works received from third parties (including: photographs, texts, music, e-mails, graphics, etc.). In this respect, it is important to remember that, although in most cases it is the contract that must form the basis of the business use of other people’s works, it often ‘concludes itself’ and this eventuality (in the case of certain business models) is worth bearing in mind without making everyday life too difficult.
